1. Definitions

1.1 “The Player” means the child attending The Sessions as detailed in the Registration Form by The Parent or Guardian. 1.2 “The Parent” means the parent or legal guardian who will be responsible for payment of The Fees. 1.3 “Damian Ives Coaching” means the company that The Parent is entering into and agreement with. 1.4 “The Sessions” means the classes you are enrolling on or attending. 1.5 “Registration Form” means the form relating to The Player containing personal & medical details and emergency contact information. 1.6 “The Coach” means the individual(s) employed by Damian Ives Coaching to deliver The Sessions. While every effort will be made to keep delivery to a consistent level Damian Ives Coaching unreservedly retain the right to change The Coach where necessary. 1.7 “The Fee” means the monetary cost of The Sessions specified upon Registration. 1.8 “The Venue” means the place where The Sessions take place. 1.9 “T&Cs” means the Terms and Conditions set out in this document by Damian Ives Coaching.

2. Payment, Fees and Cancelations

2.1 The Parent shall pay Damian Ives Coaching the whole fee prior to The Player commencing The Sessions. 2.2 2.3 The Fee is non-refundable except with the prior written agreement of Damian Ives Coaching. 2.4 The Fee will be paid during months with damian ives coaching holidays, as it will even out from a monetary perspective throughout the year. 2.5 If The Sessions are cancelled as a result of an “act of God” e.g disruption from extreme weather conditions, strikes, terrorist activity or where the local authority advise that classes should be temporarily suspended for Health & Safety reasons, then no refunds will be given and it will not be permitted to defer The Sessions during the affected period. 2.6 In the event of cancellation of The Sessions by Damian Ives Coaching prior to the commencement of The Sessions by The Player, Damian Ives Coaching will refund The Fee for the outstanding Session within 30 days. 2.7 For The Parent to cancel The Sessions notice must be sent to Damian Ives Coaching via email 2 weeks prior to the cancellation date. 2.8 In such an event as 2.7 it is The Parents responsibility to cancel the Standing Order after The Fees are paid up to date.

3. Discipline

3.1 In the event that Damian Ives Coaching determines the behaviour of The Player or The Parent to be unacceptable Damian Ives Coaching shall exclude The Player or The Parent (or both of them) permanently or for a period of time under the discretion of Damian Ives Coaching.

4. Exclusion of Liability

4.1 Damian Ives Coaching, its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay, suffered or incurred by The Parent, The Player or any other party arising directly or indirectly or in anyway connected with the attendance of The Player at The Sessions or The Venue, or any other act or omission on the part of Damian Ives Coaching or any of its coaches, employees or agents even if such act or omission is negligent

5. GDPR

5.1 Parents are advised in accordance with the General Data Protection Regulation (GDPR) that Damian Ives Coaching holds the following information about them; parent name, child’s name, home address, child’s date of birth, child’s age, email address, telephone number, child’s school year, child’s medical conditions if applicable. The information is held on a personal computer that is password protected, not accessible beyond the damiann ives coaching office.                                                                                                                                                 5.2 The information is held solely for the purpose of managing customers signing up too damian ives coaching sessions and advising them of any matters affecting their sign up aswell as informing them of updated or new coaching sessions run by damian ives coaching.                                                                    5.3 Customers details will not be shared with or passed on to anyone else without their expressd authority.  5.4 Where it is necessary to contact by email more than one customer in the same email they will be addressed as blind copies to preserve the confidentiality of the customers email address.                                            5.5 Any commnuication to The Parent about The Sessions sent via text message shall be individually sent in order to preserve the confidentiality of the customers mobile number.                                                                          5.6 Damian Ives coaching will not keep personal data longer than is necessary for the purpose(s) for which they were collected. We will take all reasonable steps to destroy or delete data which is no longer required.    5.7 Further indepth detail regarding GDPR can be found in damian ives coaching data protection policy which can be made available on request.                                                                                                                                    6. General                                                                                                                                                                  6.1 Any communication to Damian Ives Coaching from The Parent shall be sent via text message or email.   6.2  By signing the Registration Form Declaration The Parent grants media consent for Damian Ives Coaching , its coaches, servants, employees or agents to capture photograpic or video images of The Player during The Sessions to be posted on Damian Ives Coaching social media sites or website.            6.3 These T&Cs constiute that the entire agreement between the parties hereto and supersede all prior agreements and the understanding between parties. It is agreed that no statement promised or inducement, whether written or orally to have been made by either party and which is now contained herein shall be binding or form part of this agreement.
